What “Equitable Distribution” Actually Means in Florida
Florida Statute 61.075 governs how marital assets and liabilities are divided in divorce. Courts begin with the premise that marital property should be split equally, but equal and equitable aren’t the same thing. A judge can order an unequal split when the facts support it.
Factors that can shift the balance include each spouse’s contribution to the marriage (including homemaking and child care), whether one spouse supported the other’s education or career, and intentional dissipation or waste of marital assets. Dissipation means one spouse recklessly or deliberately depleted shared assets, and courts can look back two years before the divorce petition was filed when evaluating that conduct.
Marital Property vs. Nonmarital Property
Before anything can be divided, it has to be classified. Assets acquired during the marriage are presumed marital, whether held jointly or individually. The clock generally runs from the date of marriage to the date the dissolution petition is filed.
Nonmarital assets, including property owned before the marriage or received as a gift or inheritance, aren’t automatically subject to division. But that status isn’t permanent. When nonmarital funds are deposited into a joint account or used to pay down a shared mortgage, they can lose their protected character through commingling. Tracing what stayed separate and what became marital often requires careful documentation and, in contested cases, financial analysis.
